EU Package Travel Directive

Information sheet for informing travellers taking a package tour as per § 651a of the German Civil Code

The combination of travel services offered to you is a package tour as defined by Directive (EU) 2015/2302.

Therefore, you canmake use of all EU laws that apply to package tours. The company Henrich GmbH, Schonensche Str. 36, 13189 Berlin, takes full responsibility for the proper execution of the entire package tour.

The company Henrich GmbH also has the legally prescribed safeguards in place for the refund of your payments and, if transportation is included in the package tour, to ensure your return travel in the case of insolvency.*

Important rights as per Directive (EU) 2015/2302

The travellers receive all important information on the package tour before concluding the package tour contract.

At least one operator is always liable for the correct provision of all the travel services included in the contract.

The travellers receive an emergency phone number or details of a point of contact via which they can contact the tour operator or the travel agent.

Within a reasonable grace period, and in certain circumstances with the payment of additional costs, the travellers can transfer the package tour to another person.

The price of the package tour may be increased only if specific costs (for exampla, fuel prices) have increased and if this has been expressly stipulated in the contract, and in all cases at the latest 20 days before the start of the package tour. If the price increase exceeds 8% of the package tour price, the traveller can terminate the contract. If a tour operator reserves the right to a price increase, the traveller has the right to a price decrease if the corresponding costs decrease.

The travellers can terminate the contract without the payment of a cancellation fee and shall receive a full refund of all payments if a significant component of the package tour is changed, with the exception of the price. If the operator, responsible for the package tour, cancels the package tour before the start of the package package tour, the travellers have the right to a refund of costs.

In the case of exceptional circumstances, the travellers may terminate the contract before the start of the package tour without the payment of a cancellation fee, for example, in the case of serious security problems at the destination that can be expected to impair the package tour.

Additionally, the travellers can terminate the contract at any time before the start of the package tour upon payment of an appropriate and justifiable cancellation fee.

After the start of the package tour, should significant components of the package tour not be executable as per the agreement, appropriate alternative services must be offered to the traveller at no additional cost. The traveller can terminate the contract without the payment of a cancellation fee (in the Federal Republic of Germany this right is known as „termination”) if services are not provided as per the contract and this has significant effects on the performance of contractual package tour services, and the tour operator has failed to provide a corrective.

The traveller has the right to a price decrease and/or compensation if the travel services are not provided or not provided properly.

The tour operator provides the traveller with assistance should the latter be experiencing difficulties.

In the case of the tour operator’s insolvency or – in some Member States – the travel agent’s insolvency, payments shall be refunded. If the tour operator’s insolvency, or if relevant the travel agent’s insolvency, occurs after the start of the package tour and if transportation is a component of the package tour, the return travel of the travellers is provided. * If according to § 651r para. 1 of the German Civil Code the tour operator is not obligated to have insolvency insurance because the tour operator does not accept any payments by the traveller towards the tour price before the end of the package tour and the contract does not provide for the traveller’s return travel, these sentences do not apply.
